The bill suggests establish Commission on matters of rehabilitation of persons that were illegally convicted. The commission shall be composed of 15 persons, of which 10 are from among judges (retired judges) and 5 members of the public. Commission’s composition shall be approved by the Verkhovna Rada.
In case the Commission recognizes presence of signs of adoption of a court decision, the person can file a law suit in court to be granted the status of a rehabilitated.
Under the bill, in the event of acquittal, the court recognizes a person rehabilitated and the latter has the right to compensation or return of a seized property.
Compensation of harm shall be executed in the order determined by the Law “On the Order of Compensation for the Damage to a Citizen Caused by Unlawful Actions of Bodies Carrying out Investigative Activities, Bodies of Pre-trial Investigation, Prosecutor's Office and Court.
